Bill Summary

This bill directs the Department of Environmental Protection (DEP) to develop and implement a voluntary commercial applicator deicer training and registration program and establish criteria for training commercial applicators in methods for snow and ice removal and deicer applications that are effective and protect water quality. The bill requires DEP to certify third party training providers and programs at community colleges, vocational schools, universities, or other educational institutions in the State qualified to provide the training specified by the department. The bill requires each commercial applicator to successfully complete training and pass an examination prior to registering with the DEP, and thereafter to update training and registration as required by the DEP. Furthermore, the bill: 1) requires registered commercial applicators to maintain certain records and annually file certain reports; 2) establishes certain limits on liability for commercial applicators; and 3) provides for suspension or revocation of a commercial applicator registration for a violation of any provision of the bill, or for making a false statement, representation, or certification in any documents or information required to be submitted to the department, or in any records required to be maintained under the bill. Finally, the bill authorizes the Commissioner of Environmental Protection to adopt rules and regulations necessary to implement the bill's requirements.

AI Summary

This bill establishes a voluntary training and registration program for commercial applicators, defined as individuals who apply deicers (substances used to melt snow or ice) for hire, to be developed and managed by the Department of Environmental Protection (DEP). The program aims to train these applicators on effective snow and ice removal methods that also protect water quality, with training to be provided by certified third-party providers like community colleges and universities. To become a registered commercial applicator, individuals must complete this training and pass an examination, and may need to undergo periodic continuing education to maintain their registration. Registered applicators will be required to keep records of their services, including dates, methods, and amounts of deicers used, and file annual reports with the DEP. The bill also provides certain limits on liability for registered commercial applicators, protecting them from damages related to snow and ice hazards if they follow the approved training methods, though this protection does not apply in cases of reckless conduct, intentional harm, or failure to use trained methods. The DEP can suspend or revoke a registration for violations of the bill, including making false statements or failing to comply with record-keeping and reporting requirements, after providing notice and an opportunity for a hearing. The Commissioner of Environmental Protection is authorized to create necessary rules and regulations to implement these provisions, with the act taking effect on July 1st following its enactment.
