This bill authorizes the commissioner of capital asset management and maintenance, in consultation with the executive director of the Massachusetts Water Resources Authority (MWRA), to release a portion of a sewer line easement located on property at 49 Charles Park Road in West Roxbury, Boston, owned by Nora, LLC. This easement, originally established in 1897 for sewer purposes, will have a specific section released as depicted on a sketch filed with the MWRA and the division of capital asset management and maintenance, with the exact boundaries to be determined by a survey. The release will be subject to terms and conditions set by the commissioner and MWRA, and the consideration for this release will be the full fair market value of the easement portion, determined by an independent appraisal. This appraisal will be reviewed by the inspector general, and both the appraisal and the inspector general's report, along with any comments, must be submitted to legislative committees before the release is finalized. Nora, LLC will be responsible for all associated costs, including surveys, appraisals, and recording fees.
