This bill, titled "Relative to Student Online Information Protection Policies," amends Chapter 71 of the General Laws by adding a new section, Section 95, to establish protections for student data collected by online services used for K-12 school purposes. The key provisions require any operator of an internet website, online service, or application that is specifically designed and marketed for K-12 school use, and has actual knowledge of this use, to adhere to several rules. These rules prohibit the operator from using, sharing, disclosing, or compiling a K-12 student's personal information for any purpose other than the intended school purpose or to maintain the service's integrity. Furthermore, it strictly forbids using student personal information for any commercial purpose, including advertising or profiling, and prohibits facilitating or aiding in the marketing or advertising of products or services to K-12 students on these platforms. Finally, the bill mandates that operators take all reasonable steps to protect student data, both when it is stored (at rest) and when it is being transmitted (in motion), to a standard that meets or exceeds commercial best practices.
