This bill authorizes the commissioner of capital asset management and maintenance, in consultation with the president of Salem State University, to grant easements to the City of Salem for specific purposes related to stormwater drainage and sewer systems on land within the O'Keefe Center Parking Lot. An easement is a legal right to use another person's land for a specific purpose. The bill allows for permanent exclusive easements for above and below ground improvements for a stormwater drainage system, a temporary easement for construction lay-down areas, a permanent subsurface easement for drainage pipes and facilities, and permanent easements for access and egress to operate, maintain, repair, and replace these stormwater improvements. It also includes a permanent easement for access and egress to a portion of the city's sewer system and allows for the amendment of existing easements for the relocation of a sewer line. These easements will be granted on terms set by the commissioner, with the City of Salem assuming all associated costs and agreeing to a reversionary clause that extinguishes the easement if it ceases to be used for its intended purpose. The consideration for these easements will be nominal, and they will be granted without warranties from the Commonwealth.
