This bill, concerning the judicial enforcement of noncompetition agreements, proposes to add a new section to Massachusetts General Laws Chapter 149 that would render void and unenforceable any written or oral agreement arising from an employment or independent contractor relationship that restricts a person's ability to seek, engage in, or accept any type of work after that relationship ends. However, this new section would not invalidate other parts of an agreement, nor would it affect agreements related to not soliciting or hiring employees, not soliciting customers or vendors, maintaining confidentiality (nondisclosure agreements), noncompetition agreements made during the sale of a business where the restricted party is a significant owner who received substantial payment, noncompetition agreements outside of employment, forfeiture agreements, or agreements where an employee agrees not to reapply for employment with the same employer after termination. This new law would apply to all contracts and agreements entered into after its effective date.
