This bill amends existing law to prohibit any person, without privilege, from knowingly enticing a child under the age of 16 into a vehicle, unless the person has the express or implied permission of the child's parent, guardian, or legal custodian, and is not a law enforcement officer, emergency services provider, or other authorized individual acting within the scope of their duties. The bill provides affirmative defenses if the person acted in response to a bona fide emergency or to preserve the health, safety, or welfare of the child. Violations of this provision can result in imprisonment of up to 5 years in state prison or 2.5 years in a house of correction, and a fine of up to $5,000.
