This bill establishes a local government review process for certain fencing projects in the Sangre de Cristo land grant lands in Colorado, which were originally granted to settlers by Mexico in 1844 and confirmed by the United States in 1848. The bill requires landowners to submit applications to local governments before commencing large fencing projects (defined as fences at least five feet high and one mile long) that could potentially impact wildlife migration, vegetation, and local ecosystems. Local governments will have 60 days to review applications, considering factors such as the project's purpose, potential impacts on hunters' rights, floodplains, and landscape aesthetics. To receive approval, fencing projects must provide wildlife passage through specific openings (at least 20 feet wide for large mammals and 5 feet wide for small mammals) and minimize soil disturbance. The bill allows local governments to opt into these requirements and provides flexibility for approving projects if the benefits outweigh potential environmental harm. Certain projects are exempt from these requirements, including those related to public utilities, transportation, school or prison safety, and wildlife division projects. The provisions will take effect on July 1, 2025, and aim to protect the unique environmental and historical significance of the Sangre de Cristo land grant lands.
