This bill modifies existing laws related to theft crimes by allowing the value of property from multiple, related theft offenses committed by the same person within the same prosecutorial unit to be combined for charging and penalty purposes, a concept referred to as "aggregation of values." This aggregation applies to various theft offenses, including those under section 943.20 (3) (a) to (cm) and section 943.50 (4) (a) to (c). Furthermore, the bill introduces provisions that can elevate the severity of charges for repeat offenders; specifically, a person convicted of a misdemeanor theft offense under section 943.50 (4) (a) with prior theft convictions could be charged with a Class I felony, and someone charged with a felony theft offense under section 943.50 (4) (bf) to (c) with prior convictions could face a felony classification one level higher than originally specified. Importantly, when these aggregated acts are prosecuted, they can be treated as a single crime, and these new provisions apply to violations committed on or after the bill's effective date, while still allowing prior convictions to be considered for sentencing.
