Bill Summary
Under current law, a person must obtain a license from the Department of Children and Families in order to provide, for compensation, care and supervision for four or more children under the age of seven for less than 24 hours a day. Under current DCF rules, DCF regulates a child care center that provides care and supervision for four to eight children as a Xfamily child care centerY and one that provides care and supervision for nine or more children as a Xgroup child care center.Y The rules specify, among other things, the required ratio of providers to children in each type of child care center. This bill requires DCF to authorize licensed child care centers that have sufficient staff and space to provide care and supervision for four to 12 children or for 13 or more children. The bill requires DCF to update its rules so that a family child care center provides care and supervision for four to 12 children and a group child care center provides care and supervision for 13 or more children. For further information see the state fiscal estimate, which will be printed as an appendix to this bill. LRB-3780/1 MDE&EHS:cjs 2025 - 2026 Legislature SENATE BILL 364
AI Summary
This bill modifies regulations for family and group child care centers in Wisconsin by changing the number of children that define these types of facilities. Currently, a family child care center provides care for 4 to 8 children, and a group child care center provides care for 9 or more children. The bill updates these definitions so that a family child care center will now cover facilities caring for 4 to 12 children, and a group child care center will cover those caring for 13 or more children. The bill requires the Department of Children and Families (DCF) to update its administrative rules to reflect these new definitions and to authorize licensed child care centers with sufficient staff and space to provide care for these revised group sizes. Additionally, the bill adjusts licensing fees accordingly, with family child care centers (4-12 children) paying a $60.50 biennial fee and group child care centers (13 or more children) paying a $30.25 base fee plus $16.94 per child. The changes will apply to new and renewed child care center licenses, aiming to provide more flexibility for child care providers while maintaining regulatory oversight.
