This bill creates a new section of statutes requiring state agencies and local governmental units, including cities, villages, towns, counties, school districts, and other state government bodies, to consider a specific definition of antisemitism, along with its examples, when investigating discrimination. This definition is the one adopted by the International Holocaust Remembrance Alliance on May 26, 2016. This consideration applies to any law, ordinance, or policy that prohibits discrimination based on race, religion, color, or national origin, as well as to criminal penalty enhancers, which are additional penalties for crimes motivated by bias against a victim's or group's actual or perceived race, religion, color, or national origin. The bill clarifies that it does not diminish First Amendment rights, conflict with existing anti-discrimination laws, or create new civil or criminal penalties, particularly for activities protected by the First Amendment at public schools or University of Wisconsin System institutions.
