Bill Summary

This bill creates requirements for the selling and reselling of entertainment tickets. Under the bill, an operator of an entertainment venue, ticket reseller, or online ticket marketplace must disclose to a person purchasing a ticket to a place of entertainment the total price of each ticket, including all fees and surcharges, in an easily readable manner that is not false or misleading. Operators, resellers, and marketplaces may not increase the price of a ticket with respect to a particular person after the ticket is first displayed to that person, excluding certain reasonable fees. Also, under the bill, ticket resellers may not, for a commercial purpose, sell for resale an entertainment ticket for more than the face value of the ticket unless the ticket reseller has received prior authorization from the operator of the event for which the ticket was originally sold. Under the bill, Xticket resellerY does not include a person that sells an entertainment ticket for resale if the person purchased the ticket solely for the person[s own use or the use of the person[s invitee, employee, or agent nor any person that makes less than $10,000 in annual revenue from the resale of entertainment tickets. An operator, ticket reseller, or online ticket marketplace that violates the requirements in the bill is subject to a forfeiture of $1,000 for each violation and must forfeit all profits made from sales that violate these requirements. For further information see the state fiscal estimate, which will be printed as an appendix to this bill.

AI Summary

This bill establishes comprehensive regulations for the sale and resale of entertainment tickets in Wisconsin, creating new transparency and fairness requirements for ticket sellers. The bill defines key terms such as "entertainment" (which includes performances, concerts, sports, and other events), and establishes that ticket sellers—including venue operators, ticket resellers, and online ticket marketplaces—must disclose the total ticket price upfront, including all fees and surcharges, in a clear and readable manner. Sellers are prohibited from increasing ticket prices after initially displaying them to a potential buyer, with only limited exceptions for reasonable delivery fees. The bill also restricts ticket resellers from selling tickets for more than their face value without prior authorization from the original event operator. To provide additional consumer protection, the legislation specifically excludes small-scale ticket sellers (those making less than $10,000 annually from ticket resales) and individuals selling tickets they originally purchased for personal use. Violations of these requirements can result in significant penalties, including a $1,000 forfeiture for each violation and the surrender of all profits from non-compliant ticket sales, thereby creating a strong deterrent for potential misconduct in the ticket sales market.
