Bill Summary
This bill creates requirements for the selling and reselling of entertainment tickets. Under the bill, an operator of an entertainment venue, ticket reseller, or online ticket marketplace must disclose to a person purchasing a ticket to a place of entertainment the total price of each ticket, including all fees and surcharges, in an easily readable manner that is not false or misleading. Operators, resellers, and marketplaces may not increase the price of a ticket with respect to a particular person after the ticket is first displayed to that person, excluding certain reasonable fees. Also, under the bill, ticket resellers may not, for a commercial purpose, sell for resale an entertainment ticket for more than the face value of the ticket unless the ticket reseller has received prior authorization from the operator of the event for which the ticket was originally sold. Under the bill, Xticket resellerY does not include a person that sells an entertainment ticket for resale if the person purchased the ticket solely for the person[s own use or the use of the person[s invitee, employee, or agent nor any person that makes less than $10,000 in annual revenue from the resale of entertainment tickets. An operator, ticket reseller, or online ticket marketplace that violates the LRB-3200/1 MDE:wlj&emw 2025 - 2026 Legislature SENATE BILL 580 requirements in the bill is subject to a forfeiture of $1,000 for each violation and must forfeit all profits made from sales that violate these requirements. For further information see the state fiscal estimate, which will be printed as an appendix to this bill.
AI Summary
This bill creates comprehensive regulations for the sale and resale of entertainment tickets in Wisconsin, aimed at increasing transparency and protecting consumers. The legislation defines key terms like "entertainment" (which includes theatrical performances, concerts, sporting events, and other forms of entertainment), "ticket reseller" (a commercial seller of tickets after their original sale), and "online ticket marketplace" (websites facilitating ticket sales). The bill requires operators, ticket resellers, and online ticket marketplaces to disclose the total ticket price upfront, including all fees and surcharges, in a clear and easily readable manner, and prohibits them from increasing ticket prices after initially displaying them to a potential buyer (with limited exceptions for reasonable delivery fees). Additionally, ticket resellers are restricted from selling tickets above face value without prior authorization from the event's original operator, and are exempt if they are selling tickets for personal use or generate less than $10,000 annually from ticket resales. Violations of these requirements can result in significant penalties, including a $1,000 forfeiture for each violation and the forfeiture of all profits from non-compliant ticket sales, thereby providing strong enforcement mechanisms to ensure consumer protection in the ticket marketplace.
