Bill Summary

Under current law, it is a Class B misdemeanor to make a bet. This bill excludes from the definition of XbetY an event or sports wager made by a person physically located in this state using a mobile or other electronic device if the server or other device used to conduct such event or sports wager is physically located on a federally recognized American Indian tribe[s Indian lands and if the event or sports wager is conducted pursuant to a compact between a tribe and this state under the federal Indian Gaming Regulatory Act of 1988 that was originally entered into prior to April 1, 1993.

AI Summary

This bill modifies Wisconsin's gambling laws by creating a specific exception to the definition of a "bet" under state criminal statutes. The bill allows event or sports wagers made by a person physically located in Wisconsin using a mobile or electronic device, provided that the server conducting the wager is physically located on federally recognized American Indian tribal lands and the wager is conducted through an Indian gaming compact originally established before April 1, 1993. This means that certain sports and event betting conducted through specific tribal gaming servers would be legally exempt from the state's existing prohibition on betting. The provision appears designed to create a narrow legal pathway for sports wagering that involves tribal gaming infrastructure, potentially providing a specific carve-out for certain types of electronic betting arrangements that meet the precise criteria outlined in the bill.
