This bill amends Wisconsin Statutes section 961.49 to increase the maximum penalty for certain controlled substance offenses, specifically involving methamphetamine or its analogs, if the violation occurs near a homeless shelter. The bill creates a new provision, 961.49 (1m) (e), which defines this enhanced penalty scenario as occurring when a person is in, or on or within 1,000 feet of the premises of, a homeless shelter, provided the person knows or should have known they were in such a location, or the shelter was easily identifiable. The existing statute, 961.49 (2m), is then modified to include this new circumstance, stating that if a person violates section 961.65 (which deals with controlled substances) and intends to deliver or distribute methamphetamine or a controlled substance analog of methamphetamine under the circumstances outlined in the new provision (including near a homeless shelter), the maximum prison sentence for that crime is increased by five years.
