Bill Summary

Under current law, a school board or the governing body of a private school may provide pupil transportation services using vehicles other than school buses that fall into one of the following categories: 1) a motor vehicle transporting nine or fewer passengers in addition to the operator; or 2) when, at the request of the school board or governing body, the secretary of transportation determines that an emergency exists because no regular transportation is available, a motor vehicle transporting 10 or more passengers in addition to the operator. This bill increases the number of passengers who may be transported absent an emergency from nine to 14 and increases those who may be transported in an emergency from 10 or more to 15 or more. For further information see the local fiscal estimate, which will be printed as an appendix to this bill.

AI Summary

This bill modifies Wisconsin statutes related to alternative methods of pupil transportation by increasing the number of passengers that can be transported in certain vehicles without being classified as a school bus. Specifically, the bill changes the passenger limit from 9 to 14 for motor vehicles transporting passengers, and from 10 to 15 or more for emergency transportation scenarios. In emergency situations, the secretary of transportation must still approve and specify the purpose and need for such transportation services. The bill also updates related insurance requirements, mandating that vehicles transporting 14 or fewer persons (increased from the previous 9-person limit) must have specific property damage and bodily injury liability coverage if not owned by a school or school bus contractor. These changes provide school districts and private schools more flexibility in arranging transportation services by allowing slightly larger vehicles to be used for student transport without requiring traditional school bus classification.
