This bill authorizes the Commonwealth of Massachusetts, through its Division of Fisheries and Wildlife, to grant a permanent exclusive easement to the town of Barnstable for the purpose of developing and maintaining a shared use pedestrian and bicycle path, specifically to extend the Cape Cod Rail Trail. In exchange for this easement, and to ensure no net loss of protected land, the town of Barnstable is authorized to grant or assign several conservation restrictions on specific parcels of land it owns or will acquire, which are detailed with their locations and acreage. A conservation restriction is a legal agreement that limits the use of land to protect its natural or open space values. This legislation is declared an emergency law to facilitate the immediate preservation of public convenience and the completion of the trail extension.
