This bill expands existing Wisconsin law to more comprehensively address non-consensual intimate digital imagery, specifically targeting "deepfake" technology. The legislation creates new criminal penalties for creating and distributing synthetic intimate representations (deepfakes) of identifiable individuals without their consent. Under the proposed law, it would be a Class I felony to post, publish, distribute, or exhibit a digitally manipulated image or video that uses a person's face, likeness, or distinguishing characteristics to depict them in an intimate or sexually explicit context, with the intent to coerce, harass, or intimidate the individual. The bill defines a synthetic intimate representation as any technologically generated depiction that uses a person's identifying features, regardless of whether the representation includes artificial or legally generated components. Additionally, the bill strengthens existing misdemeanor provisions by making it a Class A misdemeanor not only to publish private sexually explicit representations without consent but also to reproduce such representations. This legislation aims to protect individuals from digital harassment and non-consensual intimate imagery by providing legal recourse and criminal penalties for such actions.
