This bill authorizes the town of Wayland to issue one additional license for the sale of alcoholic beverages that are not intended to be consumed on the premises, such as at a liquor store or wine shop. This license can only be granted to an establishment located within Wayland's "Mixed-Use Overlay Zoning District," a specific area defined by the town's zoning map as it existed on May 3, 2006. The town's licensing authority, which is the body responsible for issuing and overseeing these types of licenses, will approve and set the conditions for this new license, which will be subject to existing state laws regarding alcohol sales (chapter 138 of the General Laws) but will be exempt from a specific section (section 17) that typically limits the number of licenses. Importantly, this new license cannot be transferred to another person or entity for three years from its original issuance, and it cannot be moved to a location outside of the designated Mixed-Use Overlay Zoning District, with the license itself clearly marked to reflect this restriction. If the license is no longer in use at its original location, it will be returned to the licensing authority, who can then grant it to a new applicant within the same zoning district, provided the applicant meets certain requirements, including demonstrating good standing with the state's departments of revenue and unemployment assistance regarding taxes and contributions.
