Bill Summary

Under current law, when a person is convicted of a crime, the clerk of the court for the county in which the person was convicted and sentenced must provide to the crime victim a notification card that the victim may fill out to request notifications regarding future court proceedings involving the criminal defendant. This bill provides that, if the county in which the criminal defendant is convicted and sentenced has a victim and witness office, that the victim and witness office must provide the notification cards to the crime victim rather than the clerk of the court. For further information see the state and local fiscal estimate, which will be printed as an appendix to this bill.

AI Summary

This bill modifies existing Wisconsin law regarding crime victim notification cards by shifting the responsibility for distributing these cards from court clerks to county victim and witness offices in counties that have such offices. Specifically, the bill requires that when a person is convicted of a crime, the director of state courts will continue to design and prepare notification cards, which will now be provided to both circuit court clerks and county victim and witness offices. In counties with a victim and witness office, that office (rather than the court clerk) will be responsible for providing these cards to crime victims without charge. The cards allow victims to request notifications about future court proceedings related to the criminal defendant's sentence, probation modification, or other relevant legal actions. The bill also ensures that the mailing addresses of victims remain confidential and are not subject to public records requests. This change aims to streamline the victim notification process by leveraging specialized victim and witness offices to provide more direct and potentially more supportive service to crime victims seeking information about legal proceedings.
