This bill, titled the "Tamale Act," expands the Colorado Cottage Foods Act (CCFA) to allow producers to sell homemade foods that require refrigeration and those containing meat or meat products, provided the meat is federally or state inspected or meets specific exemptions. Producers of these temperature-sensitive foods must complete a food safety course focusing on time and temperature control and maintain proof of completion. The bill also authorizes county, district, or regional health agencies to issue fines and recover investigation costs for violations of the CCFA. Importantly, it removes the previous $10,000 annual net revenue cap for producers under the CCFA, meaning there is no longer a limit on how much a cottage food producer can earn. The CCFA will not apply to the sale of certain items, including raw milk, low-acid canned goods, fermented or acidified foods requiring refrigeration, alcoholic beverages, products containing cannabinoids, or foods preserved by smoking.
