The Iowa child and dependent care credit is a refundable credit calculated as a percentage of the federal child and dependent care credit, depending on the Iowa net income of the taxpayer. Currently, there are seven graduated Iowa net income thresholds used to calculate the credit. The bill reduces the number of Iowa net income thresholds from seven thresholds to four thresholds, and removes the maximum Iowa net income threshold amount used by the taxpayer to calculate the Iowa child and dependent care tax credit. By removing the maximum Iowa net income threshold amount for eligibility purposes ($90,000), any taxpayer with Iowa net income equal to or exceeding $25,000 is eligible to use 50 percent of the federal child and dependent care credit as a refundable credit against the Iowa individual income tax, regardless of whether the taxpayer’s federal credit is limited by the taxpayer’s federal tax liability. HF327 | A bill for an act creating an advanced registered nurse practitioner preceptor tax credit available against the individual income tax, and including applicability provisions. | This bill creates an advanced registered nurse practitioner preceptor tax credit available against the individual income tax. The bill defines preceptor to mean an advanced registered nurse practitioner who is a resident and who is currently licensed as a registered nurse under Code chapter 152 or Code chapter 152E, and who is licensed by the board as an advanced registered nurse practitioner. The bill defines clinical preceptorship to mean a mentoring experience under the direction of a nursing program where a preceptor is used to provide a clinical learning experience for a student who is a resident enrolled in the nursing program. In order to be eligible for the tax credit under the bill, a preceptor must provide uncompensated instruction and supervision during a clinical preceptorship, be employed at the clinical facility where the preceptorship occurs, be selected by the nursing program in collaboration with the clinical facility to participate in the clinical preceptorship, and have at least one year of experience in the preceptor role. The amount of the tax credit equals $1,000 per clinical preceptorship where at least 100 hours of clinical learning experience is provided, not to exceed $2,000 in the aggregate. The bill specifies that the tax credit is refundable, and in lieu of a refund, the taxpayer may elect to have the overpayment shown on the taxpayer’s final, completed return credited to the tax liability for the following tax year. The bill requires the preceptor to accurately document the student’s experience including the name of the student, the name of the nursing program, the hours of supervision, and the year of the student’s expected graduation. The bill requires the department of revenue to submit a report to the general assembly a report describing the activities of the tax credit for the most recent tax year for which the tax credit was available. HF140 | A bill for an act providing for the direct shipment of alcoholic liquor, providing fees, and including effective date provisions.(See HF 761, HF 993.) | This bill allows for the direct shipment of alcoholic liquor within the state. New Code section 123.42A provides for the direct shipment of alcoholic liquor and provides for an alcoholic liquor direct shipper license. An alcoholic liquor direct shipper licensee (licensee) may sell and ship any amount of alcoholic liquor to any person who is at least 21 years of age for personal use and not for resale if the licensee produces in, or imports into, the United States 150,000 proof gallons or fewer of distilled spirits per calendar year. If the licensee produces or imports more than 150,000 proof gallons of distilled spirits, a licensee may sell and ship up to nine liters of alcoholic liquor per calendar year to a person 21 years of age or older. The annual fee for the license is $25. Provisions governing the direct shipment of wine and the wine direct shipper permit are generally made applicable to the direct shipment of alcoholic liquor. The bill requires all alcoholic liquor subject to direct shipping to be properly registered with the department of revenue (department) and that products which are not listed for sale by the department must be registered to include information on the name of the manufacturer, the name of the brand, the standard of fill, the wholesale price, and other information as requested by the department. The bill also requires each licensee to make a monthly report to the department that lists the products and quantities shipped directly to residents of this state in the preceding month, the name and address of the individuals to whom the alcoholic liquor was sold in each sale, the wholesale price of the alcoholic liquor sold, the purchase price and taxes charged of the alcoholic liquor sold, the alcoholic beverage carrier permittee who delivered each shipment, and documents filed by the licensee with the alcohol and tobacco tax and trade bureau of the United States department of treasury for the preceding month, including all production, storage, and processing reports. Finally, the bill requires a licensee to remit an amount to the department depending on whether the alcoholic liquor shipped is listed for sale by the department. If the alcoholic liquor is listed for sale by the department, the permittee shall remit to the department an amount equivalent to 50 percent of the wholesale price paid by the department for the alcoholic liquor. If the alcoholic liquor is not listed for sale by the department, the permittee shall remit to the department an amount equivalent to 50 percent of the wholesale price of the alcoholic liquor as registered with the department. The bill provides that a civil penalty of 10 percent of the amount due shall be assessed and collected if the amount required to be paid to the department as provided by the bill is not paid within the time required. Generally, moneys collected by the department under Code chapter 123 for the issuance of permits and licenses, and other moneys and receipts received by the department from any other source under the Code chapter, are deposited in the beer and liquor control fund (Code section 123.17). Civil penalties imposed and collected by the department under the Code chapter are credited to the general fund of the state. The bill allows a manufacturer of alcoholic liquor and a native distillery to ship alcoholic liquor or native distilled spirits, as applicable, to individual purchasers inside this state by obtaining an alcoholic liquor direct shipper license as established in the bill. The bill replaces the wine carrier permit under current law with an alcoholic beverage carrier permit to provide for the direct shipment of alcoholic liquor as provided by the bill. HF656 | A bill for an act relating to vision benefit plans, the regulation of insurers and vision benefit managers, vision care providers, and vision care provider contracts and including effective date and applicability provisions. | This bill relates to vision benefit plans, the regulation of insurers and vision benefit managers, vision care providers, and vision care provider contracts. The bill details the standards of conduct for insurers and vision benefit managers (managers), including the requirements for a reimbursement paid by an insurer or manager to a vision care provider (provider), the calculation of an annual adjustment, the period of time for an insurer or manager to recover a reimbursement amount from a provider, the auditing time frame for an audit of a claim or a collection of a claim, a reimbursement for a covered service or covered material provided to a covered person, the identification of participating providers, and the licensure requirements for managers. “Covered person”, “insurer”, “vision benefit manager”, and “vision care provider” are defined in the bill. An insurer or manager shall not engage in any of the conduct prohibited by the bill. A contract between an insurer or manager and a provider shall not violate the provisions of the bill. An insurer and a manager shall comply with the national association of insurance commissioners coordination of benefits regulations, and the coordination of benefits shall allow for a covered person to apply all benefits to the cost of a covered service and covered material. Under the bill, for the acquisition or merger of insurers and managers, the parties to the acquisition or merger shall provide for a reenrollment period for providers. The reenrollment process and details shall be well defined and shall provide for a minimum of six months notice to providers prior to the activation of a new plan by the prevailing entity after the merger or acquisition. During the merger or acquisition, a provider shall be entitled to opt out of reenrollment without penalty or obligation to the previous contract. The prevailing entity to the merger or acquisition shall enter into updated contracts with all providers who choose to reenroll. A provider adversely affected by a violation of the bill by an insurer or manager may bring an action in a court of competent jurisdiction for injunctive relief against the insurer or manager. If a provider prevails in such action, in addition to injunctive relief, the provider shall be entitled to recover monetary damages, penalties not to exceed $10,000 for each violation, and attorney fees and costs. The attorney general may bring an action on behalf of a provider for injunctive relief against an insurer or manager. The bill applies to policies, contracts, and plans between an insurer or manager and a provider delivered, issued for delivery, continued, or renewed in this state on or after the effective date of the bill. The bill also applies to an affiliate or subcontractor used by an insurer or manager to supply covered services or covered materials to a provider or a covered person. The commissioner of insurance may adopt rules to administer the bill. The bill makes a conforming change to Code section 714H.3(2). The bill takes effect upon enactment. | In Committee |

HF75 | A bill for an act authorizing the abatement of property taxes owed on property owned by the surviving spouse of an emergency services member killed in the line of duty, and including effective date and retroactive applicability provisions. | This bill authorizes the abatement of property taxes and special assessments owed on property owned by the surviving spouse of an emergency services member killed in the line of duty. The bill defines “emergency services member” or “member” to mean a fire fighter, a peace officer as defined in Code section 801.4, a correctional officer, or an emergency medical care provider as defined in Code section 147A.1. An “emergency services member” also includes a volunteer emergency services provider as defined in Code section 100B.14(2). Under the bill, the spouse of an emergency services member (petitioner) who died in the line of duty may file a petition with the board of supervisors of the county where the petitioner’s homestead is located, requesting abatement of property taxes and special assessments assessed on the petitioner’s homestead by a taxing authority. The petition filed with the board of supervisors shall be duly sworn and shall contain a certification of good standing from the chief officer of the entity or volunteer agency of the deceased member and proof that the death of the member was the direct and proximate result of a traumatic injury incurred in the line of duty. Following receipt of the petition, the board of supervisors shall forward a copy of the petition to the governing body of each taxing authority that levies taxes or special assessments on the homestead. If the board of supervisors determines a petitioner has satisfied all relevant criteria and approves the abatement, the abatement shall apply to all applicable taxes and special assessments on the homestead, excluding those for which an objection by the governing body of the taxing authority was filed with or approved by the board of supervisors within 30 days of the board forwarding a copy of the petition. The board of supervisors may order the abatement of the taxes and special assessments that are assessed against the petitioner’s homestead for the assessment year during which the petition is filed and, if specified by the board, the taxes and special assessments for one or more future years, subject to the petitioner continuing to meet the qualifications of the bill. The bill does not apply under certain circumstances including if the deceased member ended their own life, was grossly negligent, or intoxicated, or the actions of the petitioner were a substantial contributing factor in the death of the member. The bill also specifies the method of apportioning the abatement among each applicable levy and special assessment. The bill takes effect upon enactment and applies retroactively to assessment years beginning on or after January 1, 2025. | In Committee |
