LD1949 | An Act Regarding Energy Fairness | Part A of the bill requires the Public Utilities Commission to adopt rules prohibiting the disconnection of utility services of a residential customer for nonpayment if the residential customer is enrolled in, has begun the process to enroll in or has been denied enrollment in an assistance program administered by the Public Utilities Commission or another state agency and the customer attests to the utility that the customer or a member of the customer's household is 65 years of age or older, is incapacitated or dependent or has been certified within the last 12 months as having a medical condition or disability by a medical professional or government authority. It also prohibits disconnections if a member of the customer's household has not attained 12 months of age. The commission is required to adopt a process by which a public utility may petition the commission to proceed with a disconnection of a residential customer's service that would otherwise be prohibited. Part A also prohibits a competitive electricity provider from entering into an agreement to provide service to or renew a contract for generation service for a residential consumer that, in the 12-month period prior to entering into the agreement or renewing a contract, has received low-income assistance unless the commission finds that the consumer would receive a lower rate by enrolling in or renewing the contract when compared to the standard-offer service available to that consumer. Part B prohibits certain expenses from being included in a public utility's rates, including fines and penalties, costs associated with travel, lodging and food for officers and members of a public utility's or affiliated interest's board of directors, expenditures for investor relations and certain costs associated with the attendance at, participation in, preparation for or appeal of any contested rate case proceeding conducted before the commission. If a public utility includes any prohibited expenses in rates, it is subject to administrative penalties and the commission may direct the utility to use a portion of the administrative penalties owed for the payment of a rebate to the public utility's customers. In addition to an administrative penalty, the commission is required to order the public utility to issue a refund to the public utility's customers, including interest. Part C requires the commission to adopt rules to require public utilities with over 50,000 customers to file a quarterly docket with the commission containing data from the previous quarter applicable to residential and nonresidential customers. The rules must require that the filing data include information regarding customer overdue accounts, disconnections, reconnections, deposits and payment plans. Part C also requires the commission, within existing resources, to conduct a proceeding at least once every 5 years to review administrative charges collected by a public utility with over 50,000 customers during the preceding 5-year period to ensure that such administrative charges are in compliance with applicable law. Part C also requires that if an investor-owned transmission and distribution utility includes on a customer's bill a public policy charge, the utility must include an accurate and comprehensive description of the costs and benefits of the components of public policy charges, including, but not limited to, energy efficiency programs, renewable energy programs and low-income energy assistance programs. Part D amends the definition of "assisted project" in the Maine Revised Statutes, Title 26, section 1304, subsection 1-A to lower the size threshold of a project to which the definition applies. It requires that certain percentages of total labor hours of the construction, alteration or repair of a generation facility are performed by qualified apprentices. Part D also requires the Public Utilities Commission, in executing its duties, powers and regulatory functions under Title 35-A, while ensuring system reliability and resource adequacy, to consider and incorporate environmental justice principles. It requires the commission, on or before April 1, 2026 and within existing resources, to establish a community engagement plan. | In Committee |
LD1700 | An Act to Create a Direct Investment Pilot Project Under the Maine Clean Energy and Sustainability Accelerator | This bill clarifies that the Maine Clean Energy and Sustainability Accelerator may provide capital to qualified projects in the form of direct loans. It also directs the Efficiency Maine Trust to establish and administer a renewable energy generation and grid technology pilot project through the Maine Clean Energy and Sustainability Accelerator. Under the pilot project, the trust must provide financing and investment services for renewable energy generation and grid technology such as storage to support clean energy distribution, including microgrids and smart grid applications. Within 24 months of the effective date of this legislation, and as long as sufficient funds are available, the trust must use no less than $1,000,000 of the funds held within the accelerator to provide all types of investments and financial services authorized under the accelerator to renewable energy generation and grid technology projects. It updates and adds terminology to be consistent with modernized 9-1-1 systems and federal standards; 2. It clarifies rule-making authority by designating the Public Utilities Commission as the entity responsible for rulemaking instead of the Emergency Services Communication Bureau within the commission and makes all rulemaking under the emergency services communication laws routine technical; 3. It reorganizes the provisions of law related to 9-1-1 funding; 4. LD1525 | An Act to Promote Firewood Banks in Maine | This bill establishes provisions to promote the development and operation of organizations that accept donations of firewood and provide access to firewood free of charge to individuals and families who are in need of heating assistance. These organizations are called firewood banks. The bill requires the Department of Agriculture, Conservation and Forestry, Bureau of Forestry to provide information to the public to increase awareness of firewood banks and to maintain a list on the bureau's publicly accessible website that lists all of the operating firewood banks in this State. The bureau must also develop informational resources to promote the successful operation of firewood banks in this State. In fulfilling these obligations, the bureau may consult with the University of Maine Cooperative Extension Service. The bill requires that any time there are timber or forest harvesting operations on state- owned land located within 50 miles of a firewood bank, the State is required to offer a donation of 8 to 13 cords of hardwood to that firewood bank. The bill clarifies that a firewood bank and the municipality or county in which a firewood bank is located is not liable for any damages caused by the taking or use of firewood obtained from a firewood bank. It clarifies the funding sources for activities undertaken by the interconnection ombudsman to be consistent with Public Law 2023, chapter 643, Part WWW, section 1. 2. It updates the Public Utilities Commission's annual reporting requirements to include a cross-reference to specific reporting requirements related to beneficial electrification for clarity. It also removes the requirement that the commission include in its annual report on low-income assistance programs an assessment of the effectiveness of the oxygen pump benefit and the ventilator benefit with respect to covering only those electric charges directly related to use of an oxygen pump or ventilator by the program participants. 3. It clarifies that a consumer-owned water utility is not subject to the requirements related to the issuance of stocks, bonds and notes, even if the utility's charter established in law requires authorization by the Public Utilities Commission. 4. It amends penalty provisions relating to violations committed by natural gas pipeline utilities and gas utilities to align with federal regulations. 5. LD1270 | An Act to Establish the Department of Energy Resources | This bill eliminates the Governor's Energy Office, creates a new cabinet-level Department of Energy Resources and transfers the functions of the Governor's Energy Office to the new department. The Department of Energy Resources has responsibility for oversight of state energy policies, programs and development efforts, is the designated state energy office and is directed to assess energy supply and infrastructure needs while aligning with the State's greenhouse gas reduction targets. The department also administers the Distributed Solar and Energy Storage Program and the Maine Energy Resources Development Program and coordinates state energy policy and actively fosters cooperation with the Efficiency Maine Trust. The bill establishes a process for the conduct of competitive solicitations by the department. The Commissioner of Energy Resources is appointed by the Governor and is responsible for developing and implementing the comprehensive state energy plan, overseeing energy efficiency efforts and supporting renewable energy goals, including reducing energy costs, increasing renewable energy capacity and lowering oil dependence. The bill establishes the salary range of the commissioner and deputy commissioner, adds the commissioner as a nonvoting member of the board of directors of the Maine Technology Institute and authorizes the commissioner to act as a representative of the State in the regional greenhouse gas initiative. The bill also amends the membership of the Maine State Housing Authority to require that one of the commissioners have expertise in the sustainability requirements for construction projects funded by the authority and amends the at-large membership of the Finance Authority of Maine to require that one of the members be knowledgeable in the field of clean energy finance or technology solutions to climate change. The bill requires the Department of Energy Resources to work with the joint standing committee of the Legislature having jurisdiction over energy, utilities and technology matters and staff from the Office of Policy and Legal Analysis and the Office of the Revisor of Statutes to develop legislation to effect the transition of responsibilities from the Governor's Energy Office to the Department of Energy Resources. | In Committee |

LD411 | An Act to Amend the Law Governing the Disposition of Forfeited Firearms | This bill amends the law governing the disposition of firearms that have been forfeited to the State as a mandatory part of a criminal sentence under the general sentencing provisions of the Maine Criminal Code. Current law requires that forfeited firearms used in commission of a murder or unlawful homicide crime be destroyed by the State. The bill extends the requirement to all firearms that have been forfeited as mandated by the general sentencing provisions of the Maine Criminal Code. The bill also eliminates one of the exceptions to mandatory forfeiture applying to cases in which the firearm subject to forfeiture is rightfully owned by another person. The bill amends the provision of law governing forfeiture of firearms within the Maine Juvenile Code to align with the general sentencing provisions as amended by this bill. The bill amends the relevant asset forfeiture laws to align with the narrowed exception for 3rd-party claims to firearms subject to forfeiture as provided by this bill. LD1138 | An Act to Reduce Pollution Associated with Transportation in Alignment with the State's Climate Action Plan | This bill implements the following provisions designed to limit greenhouse gas emissions from the transportation sector. 1. It amends the law regulating state monitoring of, reporting on and compliance with the requirements for gross and net annual greenhouse gas emissions reductions levels to require the Department of Transportation to adopt rules necessary to ensure compliance with those reductions levels. Under current law, the Department of Transportation is authorized but not required to adopt such rules. 2. It requires the Department of Environmental Protection, by December 31, 2025, to adopt rules establishing greenhouse gas emissions limits specific to different source categories within the transportation sector that are designed to be achieved through biennial targets imposed over a 10-year period and to ensure compliance with established gross and net annual greenhouse gas emissions levels and with the transportation-specific greenhouse gas emissions reductions projections established in the climate action plan under the Maine Revised Statutes, Title 38, section 577, subsection 5-A. The Department of Transportation is required to adopt rules necessary to ensure compliance with those greenhouse gas emissions limits established by the Department of Environmental Protection by rule. 3. It requires the Department of Transportation to develop and, by July 1, 2026, publish a plan that, at a minimum, sets forth strategies for reduction of greenhouse gas emissions from the transportation sector necessary to achieve the greenhouse gas emissions reductions and limits under Title 38, section 576-A and strategies for reduction of statewide vehicle miles traveled in accordance with the targets identified in the climate action plan. 4. It provides that, beginning July 1, 2026, prior to inclusion of a capacity expansion project in a Department of Transportation or Maine Turnpike Authority transportation improvement program, work plan or long-range transportation plan, the department or the authority, as applicable, must complete an impact assessment of the project. The bill defines "capacity expansion project" as a transportation project that results in modifications or other changes to a transportation facility and that is designed to improve vehicle travel time or increase maximum throughput. The impact assessment process is to be used by the department or the authority to determine whether a capacity expansion project is consistent with the transportation greenhouse gas emissions reductions plan under Title 23, section 4209-C, the transportation-related targets in the climate action plan and the transportation sector greenhouse gas emissions limits. The impact assessment must, at a minimum, include projections for greenhouse gas emissions associated with the capacity expansion project over a 20-year period, net change in vehicle miles traveled for the affected transportation network as a result of the capacity expansion project and the direct impacts and induced demand impacts of the capacity expansion project on vehicle miles traveled for the affected transportation network as a result of the project. If, through the impact assessment, the department or the authority determines that the project is not consistent with the plan, targets and limits, the department or the authority must alter the scope or design of the project to ensure greater consistency with the plan, target or limits, incorporate sufficient mitigation measures into the project or halt project development. The bill describes the types of mitigation measures that may be incorporated into a capacity expansion project and sets forth the criteria for determining whether such mitigation measures will be considered sufficient to allow the project to proceed. 5. It establishes the Transportation Climate Technical Committee to assist in the development and review of the transportation greenhouse gas emissions reductions plan to assist the Department of Transportation and the Maine Turnpike Authority in the implementation of the requirements and processes for evaluating the greenhouse gas emissions associated with capacity expansion projects under Title 23, section 710, and to otherwise advise the Department of Transportation, the Maine Turnpike Authority and the Legislature regarding achievement of the transportation sector targets identified in the transportation greenhouse gas emissions reductions plan, the climate action plan and the greenhouse gas emissions reductions levels and limits. | In Committee |

It also requires the commission to, when engaging in transmission and energy planning, establish mechanisms to integrate grid plans filed by large investor-owned transmission and distribution utilities, seek to improve efficiency and reliability of and reduce congestion on the grid through the consideration of grid-enhancing technologies and advanced conductors and incentivize the incorporation of low-voltage sensors to improve grid monitoring capacity. The bill also requires the commission, in consultation with the Efficiency Maine Trust and the Office of the Public Advocate, to conduct a review of the nonwires alternative investigation and recommendation process established in the Maine Revised Statutes, Title 35-A, section 3132-C. By January 1, 2026, the commission must provide a report of its recommendations to the Joint Standing Committee on Energy, Utilities and Technology.
